Sandiganbayan rejects ex-E. Samar mayor Candida’s move to junk graft raps
The Sandiganbayan 2nd Division has turned down the motion of of former Lawaan, Eastern Samar mayor Candida Gabornes who sought leave to file a demurrer to evidence which will challenge the evidence presented against her during the trial.
“Accused failed to show that the prosecution’s evidence was insufficient to establish a prima facie case against them,” read the ruling of the anti-graft court.
Because of this, Candida, who facing graft and malversation charges, should present her defense in the trial.
“The grounds raised by the accused in their motions are best appreciated in the course of trial on the presentation of defense evidence,” the court pointed out.
Candida could still file a demurrer to evidence but waives her right to present her defense.
The case concerns the purchases of spare parts and tires for Candida’s Mitsubishi Montero at the amounts of P30,601 and P11,200.
The Office of the Ombudsman which filed the charges pointed out the purchase and installation of the parts served no public purpose because it was a private vehicle.
