Sandigan grants probation request of ex-Negros mayor

The Sandiganbayan 3rd Division has approved the probation of former La Castellana mayor Alberto Nicor, Jr. in relation to his conviction over breach of conduct.
“[T]he Court resolves to suspend the execution of the said accused’s sentence and thereby place him under probation, subject to (terms and conditions),” the anti-graft court stated in a resolution Friday.
The former Negros Occidental mayor is to undergo probation for three years in his residence at Barangay Manghanoy, under the bi-monthly monitoring of his Supervising Probation and Parole Officer.
In the resolution, the court maintains that it has the ability to revoke the probation order in the event of material misrepresentation on the part of the former mayor, or any violations of the terms and conditions.
Nicor was charged with graft for reportedly issuing business permits for his and his wife’s construction business.
He then pleaded to a lesser offense, being charged with violating Section 7(a) of Republic Act No. 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees:
“Public officials and employees shall not, directly or indirectly, have any financial or material interest in any transaction requiring the approval of their office,” the law read.
The resolution, promulgated October 11, was written by Division Chairperson Amparo Cabotaje-Tang, concurred by Associate Justices Bernelito Fernandez and Ronald Moreno.
