Ex-Iloilo mayor Lopez convicted of nepotism over son’s appointment


Former San Dionisio, Iloilo mayor Peter Paul King Lopez been convicted of nepotism for having appointed his son in 2015 to an official post.

With this, the Sandiganbayan 3rd Division slapped him with a P1,000 fine with subsidiary imprisonment in case of insolvency.

In its ruling which denied his demurrer to evidence, the anti-graft court disagreed with his argument that the position of his son Carlos Paul Lopez as acting licensing officer was merely a “designation” and that his son did not even receive any salary or benefits.

“We note the irrelevancy of whether the appointee received his salary or benefits or function as such, since the gravamen of the offense of nepotism is the appointment or designation of a relative within the prescribed level of consanguinity or affinity,” read the court’s decision.

The court ruled on the basis of the evidence presented by the prosecution during the trial.

Lopez has yet to present his defense in the trial and opted to file a demurrer to evidence which sought the dismissal of the case for the prosecution’s failure to prove his guilt.

However, he filed the demurrer without leave from the court which means he has waived his right to present his defense during the trial.
