Ex-Cebu mayor Garcia wants graft case over 1997 construction deal junked
Former Cebu City mayor Alvin Garcia has asked the Sandiganbayan 4th Division to dismiss the graft case against him concerning an alleged anomalous 1997 construction deal worth P26.24 million.
In his motion, Gracia argued that the Office of the Ombudsman violated his constitutional right for the speedy disposition of cases.
“On account of inordinate delay, the Office of the Ombudsman already lost its authority to prosecute the accused in the same manner that this Honorable Court, has already been deprived of its jurisdiction to further pursue the cases against accused Garcia,” read his motion.
The anti-graft court had issued an order back in June 2014 remanding the case back to the Ombudsman, after which, Garcia filed a motion for reconsideration before the Ombudsman on April 2015.
Garcia told the court that up to know the Ombudsman still has not resolved his motion for reconsideration.
The case stemmed from the awarding of a condominium project to Octa Builders Inc.
However, the Ombudsman alleged there were irregularities in the deal which include the absence of a public bidding, the lack of approval of the city’s Development Council, and that the construction was overpriced.
