Cebu vice mayor Barcenas suspended over graft case
Carcar City, Cebu Vice Mayor Mario Patricio Barcenas has been suspended for 90-days by the Sandiganbayan 7th Division over a graft case he is facing concerning the fertilizer fund scam.
In its resolution, the Sandiganbayan reminded him that the Anti-Graft and Corrupt Practices Act mandatorily imposes suspensions against officials.
“It bears reiterating that this Court possesses no discretion to determine whether a preventive suspension is necessary to forestall the possibility that the accused may use his or her public office to intimidate witnesses, or frustrate his or her prosecution, continue committing malfeasance, or do both,” it ruled.
The anti-graft court also pointed out his motion for motion for reconsideration which he filed last Jan. 8 should also be dismissed outright since the deadline for its filing has already lapsed for two months.
The case stemmed from the local government’s purchase of 166 liters of fertilizers in 2004.
Under the graft case, Barcenas approved the purchase of the fertilizers from M.M. Castillo General Merchandise without undergoing the required public bidding.
