Former San Jose, Antique mayor Fernando Corvera has been cleared of a charges against him over unliquidated cash advances ince the Office of the Ombudsman sat on it five years before filing it before the Sandiganbayan.
“The court is not persuaded that the Ombudsman needed almost five years to review and analyze the records for thoroughness and corectness. The facts and issues in these cases are very simple and not complicated,” said the Sandiganbayan 1st in its resolution.
“After considering all the circumstances in these cases, the court is constrained to decree the dismissal of these cases for violation of the right of accused Corvera and Tordesillas to speedy disposition of cases,” said the court as it dismissed the graft and malversation charges against Corvera.
Under the charges, Corvera is accused of having failed to liquidate and return P685,477 worth of cash advances he received from 1999 to 2007.
However, the accused pointed out the Ombudsman only filed the case before the Sandiganbayan on October 2017 after five years private complainant Carlos Marquez filed a grievance form in November 2012.
