Sandiganbayan clears ex-airport GM Yap of graft due to Ombudsman’s delay

Since it took the Office of the Ombudsman almost six years to file a case, former Mactan-Cebu International Airport Authority general manager Adelberto Yap has been cleared of a graft charge over the alleged anomalous purhase of radio equipment.
“Clearly such delay in terminating such investigation run counter to the Ombudsman’s duty as mandated by the Constitution and considerably capricious and vexatious that warrants the dismissal of the instant case,” ruled the Sandiganbayan 2nd Division.
Records showed that Yap awarded to MS Electronics a contract worth P161,890.91 for the airport’s radio communications network in 2005.
The Ombudsman alleged that Yap approved the contract even though there was no public bidding, no approved budget, no referencing of a particular brandl, and the failure to verify the claim of MS Electronis that it is the sole provider of Kenwood radio products in Region VII.
Because of this, the Ombudsman claimed Yap deprived the government of the opportunity to acquire the best possible price for the communications equipment.
