Kulang sa ebidensya: Southern Leyte mayor Gamutan cleared of graft over brother’s cash advances
San Francisco, Southern Leyte Mayor Samson Gamutan Jr. has been cleared of graft charges over the alleged irregular cash advances his brother received in 2012.
The Sandiganbayan 1st Division has issued a resolution which granted the motion to quash of Samson who said the Ombudsman violated his right for the speedy disposition of his case.
“Considering that not all the essential elements were satisfied, the Court holds, and hereby rules, that the facts charged in the informations do not constitute a violation of Section 3(e) of RA 3019 (Anti-Graft Law),” read the resolution.
“With respect to the argument that the accused-movants’ right to a speedy disposition of their cases is violated, the Court hereby finds, and so holds, that the Ombudsman indeed committed inordinate delay in the conduct of the preliminary investigation,” it also ruled.
Along with Samson, the court also dismissed the charges against his co-accused, his brother and private secretary Jesus Gamutan.
Under the charges, Samson is accused of having released three disbursement vouchers for the cash advance of his brother worth a total of P393,540.17 even though Jesus was not entitled to.
